1. Who and what
These terms are between you and Usman Shafi (“I”, “me”), the developer of CipherNest, and cover the CipherNest Android app, the share viewer at share.ciphernest.io, and this website (together, “CipherNest”). By installing or using CipherNest you accept them. You must be at least 18 years old, or the age of majority where you live if that is higher, to use CipherNest.
2. The software licence
CipherNest’s source code is licensed under the GNU General Public License, version 3 or later. That licence, not these terms, governs your rights to copy, modify and redistribute the code. The name CipherNest and its logo are not covered by the GPL; you may not use them for a modified version or in a way that suggests I endorse it.
3. Your cloud account is yours
CipherNest stores your encrypted files in your own Google Drive or OneDrive. Your relationship with Google or Microsoft, including their terms, storage limits and availability, is between you and them. I have no access to your account and no control over it.
4. Your recovery phrase
CipherNest generates a recovery phrase on your device and never receives it. You are solely responsible for keeping it. If you lose it, your files cannot be recovered by anyone, and I cannot help. Please read that sentence twice.
5. The free plan and Plus
The free plan includes every feature and is limited to 1,000 files in a vault. Plus removes that limit. Plus is sold as a monthly or yearly subscription, or as a one-time Founder’s Edition purchase while seats last. Prices are shown in Google Play in your local currency and may change for new purchases; an existing subscription’s price changes only with the notice Google Play requires.
6. Billing
All purchases are made through Google Play and are subject to Google Play’s terms and refund policy. Subscriptions renew automatically until cancelled in Google Play; cancellation stops future charges and keeps Plus until the end of the paid period. I do not process payments and cannot issue refunds outside Google Play’s process. Plus is tied to your vault, which means to your recovery phrase; restoring the vault on another device restores Plus. The Founder’s Edition is a one-time purchase valid for the lifetime of the CipherNest product; it is not transferable to a different vault.
7. Acceptable use
Do not use CipherNest to store or share material that is illegal in your jurisdiction or that infringes someone else’s rights. Do not attack, overload or reverse the share viewer proxy to obtain anything other than the encrypted bytes of a link you hold. I may disable a share link’s proxying if I receive a valid legal notice about it; because the content is encrypted, I cannot inspect it and will not attempt to.
8. Availability and changes
I may change, suspend or discontinue the share viewer or any feature. Your files are always in your own cloud in a documented format, and the source code is public, so you are never locked in.
9. No warranty
CipherNest is provided “as is”, without warranty of any kind, to the fullest extent permitted by law, as section 15 of the GPL states. I do not promise that it is free of defects or that it will meet your needs. Encryption reduces risk; it does not remove it.
10. Limitation of liability
To the fullest extent permitted by law, I am not liable for any indirect, incidental or consequential loss, or for loss of data, arising from your use of CipherNest, including loss caused by a lost recovery phrase. Where liability cannot be excluded, it is limited to the amount you paid me in the twelve months before the claim.
11. Termination
You can stop using CipherNest at any time by uninstalling it; your files remain in your cloud. I may terminate these terms with respect to you if you materially breach section 7.
12. Governing law
These terms are governed by the laws of Pakistan. Nothing in them removes protections you have under the mandatory consumer law of the country you live in.
13. Changes to these terms
Changes are dated at the top of this page. Continued use after a change is acceptance of it.
14. The whole agreement
These terms, the privacy policy and the GPL are the whole agreement between us about CipherNest. If any part of these terms is found unenforceable, that part is limited to the minimum extent necessary and the rest stays in force. If I do not enforce a term on one occasion, I can still enforce it later.
